Welcome to LAYRÉS. In these Terms of Service ("Terms"), "we", "us" and "our" refer to SR & AM Pty Ltd, trading as LAYRÉS. We operate this store and website, including all related information, content, features, tools, products and services (the "Services"). LAYRÉS is powered by Shopify, which enables us to provide the Services to you.

These Terms, together with our Privacy Policy, Refund Policy and Shipping Policy, set out your rights and responsibilities when you use the Services or buy from us. By using the Services or placing an order, you agree to these Terms.

YOUR RIGHTS UNDER THE AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited. Where these Terms say anything that would otherwise do so, it does not apply to the extent of that right or remedy.

1. ACCESS AND ACCOUNT

To place an order you may need to provide information such as your name, email address, and billing, payment and delivery details. Please make sure this information is accurate and kept up to date. You are responsible for keeping your account login details secure.

2. OUR PRODUCTS

We take care to describe and photograph our products accurately. Colours may appear slightly different depending on your screen and device settings. Natural fibres such as merino wool and cashmere can show small, natural variations in texture and shade, which are a normal characteristic of the fibre and not a fault.

We may change or discontinue products, and limit quantities, at any time. This does not affect orders we have already accepted.

3. ORDERS

When you place an order, you are making an offer to buy. Your order is accepted when we send you an order confirmation. We may decline or cancel an order — for example, if a product is unavailable, a pricing error has been made, or we suspect fraud. If we cancel an order after you have paid, we will tell you and refund the full amount you paid, including shipping, to your original payment method.

Pre-order items show an estimated delivery date on the product page. If a pre-order is significantly delayed beyond that date, we will let you know and you may choose to cancel your pre-order for a full refund.

Returns and exchanges are handled under our Refund Policy, which applies in addition to your rights under the Australian Consumer Law.

4. PRICES AND PAYMENT

All prices on our website are in Australian dollars and include GST. Shipping charges are shown at checkout before you pay. For international orders, import duties and taxes charged by your country may apply and are payable by you; we will tell you about these where we can.

The price you pay is the price shown when you place your order. If a price is clearly displayed in error, we will contact you before processing your order and you may choose to proceed at the correct price or cancel for a full refund.

5. SHIPPING AND DELIVERY

Delivery times shown on our website are estimates. We will do our best to deliver within these times and will keep you informed of any significant delays. We are responsible for your order until it is delivered to the address you gave us. If your order is lost or damaged in transit, please contact us and we will arrange a replacement or refund.

6. INTELLECTUAL PROPERTY

All content on the Services — including the LAYRÉS name and logo, product names, designs, text, photographs, graphics and video — is owned by us or our licensors and is protected by Australian and international intellectual property laws. You may use the Services for your own personal, non-commercial use. You must not copy, reproduce, distribute or commercially use our content without our written permission.

7. THIRD-PARTY TOOLS AND LINKS

The Services may include tools, content or links provided by third parties. We do not control these and are not responsible for their content or practices. Your use of any third-party tool or website is subject to that third party's own terms.

8. RELATIONSHIP WITH SHOPIFY

LAYRÉS is powered by Shopify, which enables us to provide the Services to you. Any purchases you make in our store are made directly with LAYRÉS, and Shopify is not responsible for any aspect of sales between you and LAYRÉS.

9. PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy and, where relevant, Shopify's Privacy Policy, available here.

10. REVIEWS AND FEEDBACK

If you send us reviews, comments, ideas or other feedback, you allow us to use, publish and display them in connection with the Services, without payment. Please make sure anything you submit is your own, is accurate, and is not unlawful, offensive or misleading. We may decline to publish, or remove, feedback that breaches these Terms, but we will not remove genuine reviews simply because they are negative.

11. ERRORS

Occasionally there may be errors on the Services, for example in product descriptions, pricing, availability or delivery times. We will correct errors when we become aware of them. If an error affects an order you have placed, we will contact you before proceeding, and you may choose to cancel for a full refund.

12. ACCEPTABLE USE

You must use the Services lawfully. You must not misuse the Services, interfere with their security or operation, upload malicious code, scrape or copy our content, impersonate others, or use the Services to harass or harm anyone. If you use an automated tool or agent to access the Services, it must identify itself as such and must not bypass any measures we use to manage automated access.

13. SUSPENDING ACCOUNTS

We may suspend or close an account if we reasonably believe it is being used fraudulently or in serious breach of these Terms. This does not affect orders you have already paid for, which we will fulfil or refund in full.

14. LIABILITY

Subject to your rights under the Australian Consumer Law, which cannot be excluded, we are not liable for loss that is not reasonably foreseeable, or that is caused by something outside our reasonable control. Nothing in these Terms limits our liability for loss caused by our negligence, fraud or wilful misconduct.

15. CHANGES TO THESE TERMS

We may update these Terms from time to time, for example to reflect changes in the law or how we operate. The Terms that apply to your order are the Terms published on our website at the time you place it. We will give notice of significant changes on this page.

16. GENERAL

If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms continue to apply. Our failure to enforce any part of these Terms is not a waiver of our rights.

17. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria. If you are a consumer outside Australia, you may also have rights under the laws of your country that these Terms do not affect.
